1. ALL SELLER CHECKS WILL BE MAILED THE  SECOND FRIDAY AFTER SALE DAY.

2. Do not consign your horse to this sale unless you are going to take him off the market. Any consignor who sells his horse after consigning it to this sale will be banned from buying or selling at any future sale. Also, all other horses consigned will be scratched and all catalog fees forfeited. 3. Footnotes must be included now with all performance information, limited to a small paragraph on each horse. What you send is what will be in the catalog. Sales manager may edit footnotes.

•Good photos accepted for use in catalog (will be used at Sale Management's discretion)

•There will be a TV/VCR/DVD unit available to show your video as your horse is sold. One horse per video tape only for sale day. Small or large VHS or DVD - NO 8mm.4. CONSIGNMENT BLANKS MUST BE ACCOMPANIED BY ORIGINAL REGISTRATION PAPERS OR CLEAR COPY COMPLETE BREEDER CERTIFICATE ON ALL BRED MARES OR THEY WILL SELL AS OPEN, SIGNED TRANSFER, THE NON-REFUNDABLE CATALOG FEE AND FOOTNOTES FOR THE CATALOG. (All transfers must be current—double transfers will not be accepted)

HORSES WILL NOT BE CATALOGED IF ABOVE REQUIREMENTS ARE NOT MET. 5. A signed breeders certificate must accompany all bred mares and mares with foals at side. It is sellers' responsibility to provide all correct paper work, transfers and breeders certificate. Seller will NOT be paid until all paper work is in office.

6. The Sales Company and its associates act as mediator only on all sales and are not responsible for buyer or seller error or misunderstanding. (All responsibilities and guarantees lie solely between buyer and consignor.)7. Any defects or bad habits must be called when horse is sold (to include soundness of eyes and wind, not a cribber or wind sucker, has not been nerved or have a navicular disease, or is foundered, or any lameness, is not parrot mouthed. Any stallion 18 months of age on sale day must have two testes descended to the scrotum, if they are not, that must be announced. Stallions younger than 18 months on sale do not have to meet the two testes descended rule. If these or any other condition is announced, the consignor is held harmless for them). In the event a dispute should arise as to a particular defect which should have been, but was not announced as described above, the buyer has the right to have a veterinarian examine the horse he has purchased to determine if the horse suffers from the defect. THIS EXAMINATION IS TO BE MADE AND TOM LOCKWOOD IS TO BE NOTIFIED WITHIN 48 HOURS FROM THE END OF THE SALE IN WHICH THE HORSE WAS SOLD. If the purchaser’s veterinarian determines the horse to have the alleged defect, the Sales Management as agent shall appoint a veterinarian of its choice to determine if the horse has the defect (s) and if the defect was present at the time of sale. His or her decision will be final. If the veterinarian determines that the defect was present at the time of sale and it was not announced, the sale of said horse shall be null and void and the consignor must pay entry fee and commission, and the cost of any veterinary examination. If the horse is determined by The Sales Management veterinarian not to have the alleged defect, the sale of said horse is valid and enforceable and purchaser assumes all costs of examination and treatment. If the buyer rightfully rejects the animal in the manner stated above and within the time provided, the animal will be returned by the buyer to the consignor and the consignor will refund the full purchase price of the animal together with all reasonable expenses incurred by the buyer in the connection with the animal from the time of sale until the return to the consignor. Also, the 8% commission will be due on any horse sold that is turned down by the buyer for any reason).

7. The commission will be eight percent (8%) of the selling price. The consignor will have the right to no sale (Pass Out) his horse - horse must be passed out in the ring. If not, when the horse leaves the ring it is sold. There is a $35.00 PO Fee.9. The auctioneer will announce at the time of sale whether horses of the Impressive bloodline have or have not been tested for HYPP.

8. Only horses consigned to the sale will be allowed on the sale grounds. All horses sold during and after the sale will be subject to the 8% sales commission in addition to the catalog fee. All consignments must go through the sale ring

9. INDIVIDUAL NEGATIVE COGGINS TEST current within 6 months.

10. All horses must be on grounds by 9:00 p.m. the day before the sale. ($25.00 late arrival fee per head.)

11. Tom Lockwood reserves the right to protect any and all Consignors.

12. NO substitutions unless accompanied by a veterinary statement of illness, disease, injury or unsoundness and a $30.00 fee will be charged.

13. In the event a Buyer fails to pay for or accept a horse sold for any reason, the Sale Management Company reserves the right to accept the same purchase amount from another person, accept the next highest bid, put the horse up for sale a second time, or return it to Consignor as unsold. In any case, where a horse is not paid for in full, including refusing to pay, stop payment or returned check or unacceptable check, Tom Lockwood will make every effort to collect the funds but if he fails to do so, the Consignor agrees to receive the horse back as unsold without any liability to the Sale Management Company and return the sale proceeds.

14. Consignor must furnish feed and care for horse until the horse is sold, move the horse through the auction ring and back to the pen he came from.

15. WARNING: Under Texas law, (Chapter 87, Civil Practice and Remedies Code), an equine professional is not liable for an injury to or the death of a participant in equine activities resulting from the inherent risks of equine activities.

16. Per AQHA Rule 224, APHA Rule 155 Sect C1 and Tom Lockwood Horse Sales, transfer forms will be completed in their entirety, particularly the name and address of the buyer. The original registration certificate and completed transfer form along with the transfer fee will be forwarded to the appropriate association for transfer fifteen (15) banking days after sale day. Cash buyers only may receive papers and complete transfer sale day. The $15.00 transfer fee will be deducted from the sellers check.

17. Catalog advertisements available, 1/2 page $150. - full page $300. - 1/2 page cover $500. - 5000 copies printed.
